1. Use of Website

You agree to:

• Provide accurate and truthful information
• Not misuse, download, screen-record, copy, or repurpose any content on the website
• Only use Indigo’s content for its intended marketing purpose

Any unauthorized use of Indigo-produced content is strictly prohibited.

2. Intellectual Property

All videos, photos, scripts, creative assets, marketing materials, and digital deliverables created
by Indigo Film Productions are the exclusive property of Indigo Film Productions, LLC until all invoices are paid in full.

Indigo may withhold delivery or revoke usage rights for unpaid or disputed accounts.

3. Payment & Deposits

• A 50% non-refundable deposit is required to secure any production date.
• Most services require full payment prior to filming.
• Services delivered but not yet paid for remain Indigo’s property.

4. Refund & Cancellation Policy

4.1 Scope of Agreement

This policy applies to all clients booking video production services with Indigo Film
Productions. By booking, you acknowledge and agree to these terms.

4.2 Cancellation Fees

• More than 5 business days before shoot:
  Refund minus $250 administrative fee + any incurred expenses.
• 2–5 business days before shoot:
  50% of total project cost is non-refundable.
• Less than 2 business days before shoot:
  100% of project cost is non-refundable.

4.3 Rescheduling

• More than 5 business days:
  No fee, subject to availability.
• 2–5 business days:
  $150 rescheduling fee.
• Less than 2 business days:
  Treated as cancellation. A new booking is required.

4.4 Notification Requirements

All cancellation or rescheduling requests must be submitted in writing via email to IndigoFilmPro@outlook.com.

The timestamp of receipt determines applicable fees.

4.5 Exceptions

Emergency exceptions (illness, natural disaster) may be granted at Indigo’s discretion with documentation.

5. Client Responsibilities

Clients agree to:

• Provide accurate project details
• Respond promptly to communication
• Not misuse, alter, or republish Indigo’s intellectual property
• Understand that creative deliverables are subjective and results may vary

6. AI Usage Disclaimer

Indigo Film Productions may use AI tools and systems (including voice agents, automation tools,
project communication AI, and CRM-integrated AI features) to assist with:

• Scheduling
• Communication
• Lead follow-up
• Workflow automation

AI tools do not replace human oversight.

By interacting with our systems, you consent to AI processing for business purposes.

7. Limitation of Liability

Indigo Film Productions is not liable for:

• Lost revenue or business outcomes
• Delays caused by weather, equipment malfunction, or third-party issues
• Creative dissatisfaction (though revisions may be available)

Maximum liability is limited to the amount paid for the specific service.

8. Dispute Resolution

Before pursuing legal action, both parties agree to:

1. Mediation first
2. If unresolved, move to arbitration
3. Only after arbitration may either party pursue additional legal remedies

All proceedings occur in Texas, under Texas law.

9. Termination of Services

Indigo may terminate services for:

• Nonpayment
• Abuse or harassment toward staff
• Fraudulent information
• Violation of Terms

Unused portions of prepaid services may or may not be refunded at Indigo’s discretion based on the circumstances.

10. Changes to Terms

We may update these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.
